TAP 2 SEND
WEBSITE TERMS & CONDITIONS
1. Introduction
These Website Terms & Conditions (“Terms”) govern access to and use of the Tap 2 Send website operated by Tap 2 Send Ltd, a company incorporated under the laws of British Columbia (“Tap 2 Send,” “Company,” “we,” “our,” or “us”). By accessing or using this website, you acknowledge and agree to these Terms. If you do not agree, you should discontinue use of the website. If you use the website on behalf of a company or another legal entity, you represent that you have appropriate authority to act on its behalf.
2. Our Business
Tap 2 Send is a Canadian financial services business focused on providing or facilitating eligible business-to-business financial services, which may include international business money transfers, cross-border payments, foreign exchange services, fiat-to-cryptocurrency conversions, cryptocurrency-to-fiat conversions, and related financial services where permitted. Services are subject to applicable law, regulatory requirements, business eligibility, customer verification, transaction approval, and relevant contractual terms. Website references do not guarantee availability for any person, business, country or transaction.
3. Website Information
Content is provided for general informational and business enquiry purposes. Descriptions do not constitute a binding offer, transaction agreement, investment recommendation or assurance of availability. Tap 2 Send may amend website information as services, regulations and arrangements evolve.
4. Eligibility
Services are intended primarily for businesses and authorized representatives. To request services, you must have legal capacity or business authority, submit accurate information, act lawfully, satisfy eligibility requirements, complete applicable identity and business verification, and comply with applicable laws and contracts. We may decline enquiries or requests where permitted or required by law.
5. Website Use
You must not use the website unlawfully; engage in fraud or deception; submit false information; attempt unauthorized access; introduce malware; circumvent security; disrupt functionality; infringe intellectual property; use unauthorized automated extraction tools; or misrepresent your identity or authority. We may restrict access for suspected misuse, security concerns or other legitimate reasons, subject to law.
6. Business Onboarding
A website enquiry or application does not create an account or binding financial-services relationship. Before providing services, we may require corporate registration documents, ownership and beneficial ownership information, identification of authorized individuals, business activity information, source-of-funds documentation, transaction purpose and expected activity, and other compliance information. Approval remains subject to regulatory, compliance, operational and commercial considerations.
7. Separate Financial Services Agreements
Actual services may be governed by Master Services Agreements, business account terms, transaction instructions, foreign exchange confirmations, digital asset terms, pricing schedules, risk disclosures and other customer documents. These Website Terms are not a financial transaction agreement. If executed transaction terms conflict with these Terms regarding a financial transaction, the transaction agreement governs, subject to mandatory law.
8. International Money Transfers
Transfers may be subject to customer and beneficiary verification, transaction screening, banking and payment network requirements, supported currencies and jurisdictions, partner availability, funding verification, limits, regulatory restrictions and other conditions. Settlement times vary. We do not guarantee immediate delivery or a particular timeline unless expressly agreed in binding transaction terms. Processing may be delayed, declined or restricted where legally required or permitted.
9. Foreign Exchange
Foreign exchange converts one currency into another. Rates and costs may depend on market conditions, currency pair, amount, timing, liquidity, fees, margins, approval and settlement arrangements. Website rates are illustrative unless expressly identified as a binding quote. Rates are not guaranteed until binding transaction terms establish them, and market fluctuations may affect pricing before confirmation.
10. Digital Asset Services
Where legally and operationally available, Tap 2 Send may facilitate eligible fiat and supported digital-asset conversions. Risks include volatility, loss of value, liquidity limits, technology failures, blockchain congestion, cybersecurity threats, regulatory changes, network fees, delays, irreversibility, incorrect wallet information and counterparty failure. Customers must understand these risks and review transaction disclosures.
11. Cryptocurrency On-Ramp Services
On-ramp services convert eligible fiat funds into supported digital assets. Availability depends on onboarding, regulatory requirements, supported assets and networks, acceptable funding methods, approval, payment confirmations and contractual terms. We do not guarantee support for every cryptocurrency or network.
12. Cryptocurrency Off-Ramp Services
Off-ramp services convert supported digital assets into fiat. Transactions may require business verification, blockchain screening, source-of-funds information, wallet verification, blockchain confirmations, financial institution approval and other checks. Timing and payment methods vary. Unsupported assets or incorrect networks may result in irreversible loss.
13. Fees and Pricing
Charges may include service fees, foreign exchange margins, processing charges, third-party bank charges, blockchain fees and other disclosed costs. Fees are communicated through the relevant quotation, confirmation or service agreement. An enquiry does not lock a rate or create an obligation to transact.
14. Transaction Instructions
Approved customers are responsible for accurate instructions, including beneficiary, bank, currency, digital asset, network, wallet, amount and business-purpose details. Amendment, cancellation, recall and refund rights depend on law, transaction status, payment infrastructure and the customer agreement. Blockchain transactions may be irreversible.
15. Anti-Money Laundering and Financial Crime Prevention
Tap 2 Send meets applicable financial-crime requirements and may conduct identity verification, sanctions screening, monitoring, beneficial-ownership assessments and other checks. We may request information, restrict activity or decline transactions under law and contract. Certain reporting is confidential, and nothing requires disclosure where unlawful.
16. Sanctions and Restricted Transactions
Users must not use our services for transactions prohibited by sanctions laws or other legal requirements. We may refuse or restrict activity involving prohibited jurisdictions, sanctioned parties, unlawful businesses or other restricted transactions. Customer agreements may establish further restrictions.
17. No Banking Relationship or Deposit Insurance Representation
Tap 2 Send is not a chartered bank, trust company or deposit-taking institution solely because it provides money services. Unless expressly confirmed through legal disclosures, customers should not assume funds or digital assets are eligible for Canada Deposit Insurance Corporation protection. Safeguarding arrangements will be described in relevant documentation.
18. No Investment Advice
Tap 2 Send does not provide personalized investment, securities, tax or legal advice through this website. Website content is not a recommendation to purchase, sell or hold digital assets. Obtain independent advice where appropriate.
19. Intellectual Property
The website, branding, logo, text, graphics, layout and original content are owned by Tap 2 Send or licensed to it. Users may access the website for lawful informational purposes. Reproduction, redistribution, commercial exploitation or unauthorized modification is prohibited unless permitted by law or authorized in writing.
20. Third-Party Services
Services may involve independent financial institutions, payment providers, technology vendors and digital-asset providers. Third-party terms may govern aspects of a transaction. Tap 2 Send is not responsible for independent third-party websites or services beyond legal responsibilities or applicable agreements.
21. Website Security
Users must not access restricted resources or interfere with security controls. Do not submit passwords, private keys, seed phrases or sensitive documents through ordinary website forms. No online service is completely free of security risk.
22. Privacy
Personal information submitted through the website is processed under our Privacy Policy and applicable law. The Privacy Policy explains collection, use, disclosure, retention, safeguards and privacy rights.
23. Electronic Communications
By submitting a business enquiry, you authorize Tap 2 Send to contact you about that enquiry using the information provided, subject to law. Marketing communications are subject to consent and unsubscribe requirements. You may withdraw marketing consent as described in our Privacy Policy.
24. Availability and Maintenance
Website access may be interrupted by maintenance, outages, security issues or other operational circumstances. We may update, suspend or discontinue features in accordance with legal and contractual obligations.
25. Disclaimers
To the maximum extent permitted by law, the website and general informational content are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted, error-free access or suitability for a particular business purpose. Nothing excludes a guarantee, right, duty or liability that cannot lawfully be excluded.
26. Limitation of Liability
To the fullest extent permitted by law, Tap 2 Send will not be liable for indirect, incidental, special or consequential damages arising solely from use of the informational website, including technical interruptions or reliance on general information. These limits do not exclude liability for fraud, intentional misconduct, mandatory statutory obligations or other liability that cannot legally be excluded. Liability for actual financial services is governed by law and the relevant agreement.
27. Indemnification
To the extent permitted by law, users agree to indemnify Tap 2 Send for reasonable third-party claims, liabilities and expenses resulting directly from unlawful website activity, material breach of these Terms or infringement of third-party rights. This does not require indemnification for losses caused by Tap 2 Send’s own unlawful conduct or where prohibited by law.
28. Complaints
Website and service-related complaints may be submitted to [COMPLAINTS EMAIL]. Complaints will be reviewed under applicable procedures and legal obligations. Regulatory complaint and escalation information will be provided where legally required.
29. Modifications
We may update these Terms periodically. Updated Terms will be made available on the website with a revised effective date. Where law requires notice or consent, those requirements will be followed. Changes to separately executed service agreements are governed by those agreements.
30. Governing Law
These Website Terms are governed by the laws of British Columbia and applicable federal laws of Canada, subject to mandatory legal rights and jurisdictional requirements. Disputes are subject to courts of competent authority as permitted by law.
31. Severability
If a provision is invalid or unenforceable, the remaining provisions remain effective to the extent permitted by law.
32. No Waiver
Failure to enforce a provision does not waive that provision or any other legal right.
33. Entire Agreement for Website Use
These Terms and documents expressly incorporated into them govern general website use. They do not supersede separately executed financial-services agreements.
